These terms govern your use of Chatstat's websites, applications, dashboards, notifications, AI Guide, and related services (the "Service"). By creating an account or using the Service you agree to these terms, our Privacy Policy, our Acceptable Use Policy, and our AI and Notification Disclaimer, which together form the agreement between you and Chatstat.
If you use the Service through a school, university, workplace, or government customer, the written agreement between Chatstat and that customer prevails over these terms to the extent of any inconsistency.
You must be at least 18 years old to create a Chatstat account. You are responsible for keeping your login credentials secure and for activity under your account. Provide accurate information and keep it current.
Chatstat analyzes publicly available social media content and, for organizational customers, employer-authorized communication channels, to surface possible safety and wellbeing risks and to support timely human action. The Service provides decision-support information. It is not a clinical, medical, legal, or emergency service, it does not diagnose any person, and it is not a guarantee that risks will be detected. The AI and Notification Disclaimer describes these limits in detail and forms part of these terms.
You may only register a person for monitoring where you have lawful authority to do so:
You warrant that this authority exists for every subject you register and that you will remove a subject when your authority ends. Monitoring of a young person under guardian authority ends automatically from the start of the calendar month in which they turn 18, and their profile is closed. Any future monitoring of that person could only occur with their own consent as an adult. Using the Service to monitor an adult without lawful authority, including a former partner, is prohibited and grounds for immediate termination.
Where the Service is provided to a school, university, workplace, or government body, the customer is responsible for its own legal obligations to the people it monitors, including any required notices to students, families, or workers under applicable law, and for configuring the Service accordingly. A Data Processing Addendum is available for customers that require one. Enterprise API and MCP access is subject to the tier controls described in our Privacy Policy and to the Acceptable Use Policy.
Paid plans are billed in advance on the cycle shown at purchase and renew automatically until cancelled. You can cancel at any time with effect from the end of the current billing period. Trials convert to paid plans unless cancelled before the trial ends. Prices are shown at checkout, and payment is processed by our payment provider, Paddle, whose terms also apply to the transaction. Where you purchase as a consumer in Australia, nothing in these terms limits your rights under the Australian Consumer Law, including your rights to remedies for services that fail to meet consumer guarantees.
You must comply with the Acceptable Use Policy. In short: use the Service only within your lawful authority, do not attempt to access private content or defeat the Service's protections for people under 18, do not misuse the API or MCP, and do not use Chatstat outputs to make automated decisions about people without human review.
Fair use and service limits. The Service is designed for monitoring accounts and channels you have authority over, within reasonable personal or organizational use. We apply technical limits to collection, such as fetch frequency, volume, and history depth, and these may change as the Service evolves. We may throttle, flag for review, or suspend usage patterns that indicate abuse, circumvention of limits, or use of the Service as a general-purpose data harvesting tool, acting proportionately and, where practical, with notice.
Chatstat and its licensors own the Service, including software, models, designs, and content we provide. We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose during your subscription. You retain rights in the information you submit, and you grant us the license needed to operate the Service, consistent with the Privacy Policy. We may use de-identified, aggregated data to improve the Service.
Alerts, classifications, severity bands, and AI Guide responses are generated by automated systems and can be incomplete or wrong, including false positives and false negatives. They are indicative information for your judgment, not findings of fact. You are responsible for decisions you make, or decline to make, in reliance on the Service, and for seeking qualified human help where a situation may involve harm. In an emergency, contact local emergency services.
We aim for continuous availability but do not guarantee that the Service, or any alert or notification, will be uninterrupted, timely, or error-free. We may improve, modify, or discontinue features, and we will give reasonable notice of material reductions affecting paid plans.
Nothing in these terms excludes, restricts, or modifies rights or remedies that cannot lawfully be excluded, including consumer guarantees under the Australian Consumer Law and liability for death or personal injury caused by negligence, fraud, or willful misconduct.
Subject to that, and to the maximum extent permitted by law: the Service is provided on an "as is" and "as available" basis; we exclude implied warranties; we are not liable for indirect or consequential loss, loss of data, or loss of profits; and our total aggregate liability arising out of or in connection with the Service is limited to the amounts you paid to Chatstat in the 12 months before the event giving rise to the claim, or, where liability under the Australian Consumer Law cannot be so limited, to resupply of the services or payment of the cost of resupply.
You acknowledge that Chatstat is a decision-support tool and must not be relied upon as the sole safeguard for any person.
You may close your account at any time. We may suspend or terminate access for breach of these terms or the Acceptable Use Policy, for unlawful use, or where required by law, and we will act proportionately. Sections that by their nature survive termination, including liability, intellectual property, and dispute terms, survive.
These terms are governed by the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of its courts. For organizational customers, a signed master services agreement may specify a different governing law, and that agreement prevails.
We may update these terms. Material changes are notified through the Service or by email with reasonable notice, and continued use after the effective date constitutes acceptance. The date at the top reflects the current version.
